一、亚马逊平台会涉及到的侵权有哪些?
1. 版权：侵犯版权，通常指侵犯作者的著作权。这类侵权，中国卖家还是比较少碰到。
2. 商标权：未得到产品品牌官方的正规授权，擅自使用对方的商标或LOGO。
3. 发明专利权：如果出售的产品是别人发明的，而且别人申请了专利保护，卖家未经允许擅自生产销售，也就是指销售仿品。
4. 外观设计专利权：是指对产品的形状、图案、色彩或者其结合所做出的富有美感并适于工业上应用的新设计。外观设计是指工业品的外观设计，也就是工业品的式样。外观专利有60%以上相似就视为侵权假货
二、亚马逊产品侵权申诉要点：
1.第一时间下架侵权产品不要抱有侥幸心理，并检测整个店铺是否有类似产品全部下架。
2.联系邮件中给出的投诉者，承认错误无心之失，言辞恳求，告知已经下架产品承诺不再销售他们品牌的产品并抄送给亚马逊notice邮箱。

三、如何避免亚马逊产品侵权?
1.保证供货渠道的正规性，在进行选品之时，就要从货源供应链上防止产品可能存在的侵权问题。了解生产商/供货商的生产能力，生产资质，杜绝仿品、假货。如果发现某个产品上面印有别人家的商标，最好先在商标网站上进行查询，一旦发现商标有效，而同时商标主体并不是你的供应商，供应商也无法给你提供授权书，此时，建议不要销售该产品。
2.卖家作为代理商，在亚马逊上销售某个品牌的产品，在刊登listing之前就需要先取得品牌商标的正规授权。需要注意的是，只有商标持有人才有资格进行品牌授权，一些代理商，是没有资质给其他在亚马逊开店的卖家授权的，只有取得了商标持有者的正规授权，卖家才有合法使用商标权。
3.刊登listing时，建议使用原创类图片、文字描述。Listing的标题、还有Search terms里面的关键词，也不能带有他人的品牌名称。
4. 设置店铺名时，需要注意店铺名中是否有涉及他人注册的商标。不能复制其它知名品牌名称，也不能打擦边球使用容易误导买家的品牌名称。
三、卖家收到侵权以后应该怎么成功申诉?
1、首先审视自己是否侵权，如果确实没有侵权，或者有授权书，可以直接与亚马逊官方沟通，提供相关证据，证明自己。
2、查清楚对方的商标专利申请情况，如果对方提供了专利详情，确认产品侵权，这种情况的话直接下架listing， 并且积极和投诉方沟通，看是否可以通过签订保证书或者给一些赔偿金，让其撤诉。如果对方要求的赔偿金较多，卖家可以去审视一下自己的账号是否值得挽救回来，或者也可以请知识产权律师代为沟通。
3、如果平台直接下架了listing，联系对方拒绝提供专利详情，这种情况可以联系平台告知说对方可能是恶意骚扰，拒绝提供任何的侵权证明，要求平台恢复销售权限。
